Terms and Conditions

Member agrees to be bound by the following membership terms and conditions:

general definition

In this agreement several terms are used, “Manual Book” means the Member's handbook can be changed at any time by Share Car which is an integral part of this agreement. “Member” means an applicant who has registered and has been verified by Share Car. “Vehicles: means motorized vehicles leased to Members by Share Car under this agreement. “Share Car” is a business unit of PT Adi Sarana Armada Tbk.

  • Members are required to fill out the registration form with information and personal data of the Member which can be guaranteed & validated for by the Member.
  • Members are at least 21 years old, have a SIM that has been active for at least 1 year and still valid for at least 1 month before expired.
  • Members are required to renew driving license on Share Car application or portal before expires.
  • Members are only allowed to have one account registered in Share Car.
  • Member certify that they have the mental and physical capacity to drive a car competently, safely and are willing to comply with applicable traffic regulations.
  • The holder of a driving license that has expired, been suspended, canceled, lost or stolen, doesn’t meet the requirements to become a Member and also doesn’t meet the requirements for insurance coverage and is responsible for penalties that may be imposed by the relevant authorities.
  • Members acknowledge, understand and agree that by fulfilling the requirements specified by Share Car, they do not automatically become Share Car Member. Approval to become a Share Car Member is entirely Share Car decision. Decision regarding your membership status will be informed via electronic mail.
  • Share Car has the right to refuse membership or stop Share Car services to Member at any time if a Member is found to have the potential to harm Share Car and Share Car is not required to explain the reason for stopping services and/or revoking your membership.

Share Car Usage Rules

  • Member must drive and use the vehicle properly and safely, comply with applicable traffic regulations and not drive the vehicle beyond the geographical area boundaries determined by Share Car. Share Car usage area boundaries include: Jabodetabek - Merak Harbor, Semarang. Bali - Island of Bali.
  • Members are not allowed to make booking for other people. If the Member violates it, Share Car has the right to terminate or deactivate the Member's Share Car account and Member will be fined according to the applicable Share Car regulations.
  • Members are not allowed to use Share Car for learn to drive or teach others to learn to drive a car.
  • Members are fully responsible for all costs (including vehicle repair costs or vehicle compensation) arising from violating the articles stated in these terms and conditions.
  • Members are not allowed to use Share Car for rental / lease back to others, online taxis, offline taxis, transportation services or other rentals.
  • Members are not allowed to use Share Car to carry alcohol, drugs, firearms or other similar dangerous goods.
  • Members are responsible for vehicle registration, car keys (especially for cars that have not used a “push button”) and parking card during booking period. If there is a loss, Member will responsible for the cost that appear.
  • Share Car has the right to take over or disable the vehicle that will be or is being used by Member if Share Car believes that the Member has a risk of misusing the vehicle.
  • Share Car has the right to take pictures or videos on the vehicle through a surveillance camera that will be used for the security purpose of Members and vehicles.
  • Maximum duration of Share Car rental is 2 days. If a Member wants to rent for more than 2 days, the Member must confirm in advance with Share Car. If not, then the Member will be fined with an amount according to what has been regulated in these terms and conditions.

Vehicle Inspection

  • Member must check the exterior and interior of the vehicle, check the fuel level and vehicle kilometers and take photos of the car dashboard before and after using the vehicle.
  • If at the time of checking, the Member find damages, defects or dirty condition of the vehicle, Member must report it to Share Car by using the features available in the application before and after using the vehicle. If there is no report, it is assumed that the vehicle is in good condition and free from damage and if damage is found in the future, Member will responsible for the cost of the damage.
  • If damage is found after the trip and the Member cannot provide photos or evidence showing that this happened not during the Member's trip, the Member must be responsible for repair cost and/or insurance cost for the vehicle.

Vehicle Ownership

  • All vehicles including all accessories, tools, spare tire keys, documents (vehicle registration, parking card, etc.) and other supporting equipment are the property of Share Car and Members are not allowed to release, move, exchange, modify and take these accessories.
  • Members are not allowed and have no right to mortgage or pledge Share Car vehicles or transfer ownership of Share Car vehicle to other people.

VEHICLE RETURN

  • Members are required to return the vehicle according to the initial location at the time of booking.
  • Members are required to return the vehicle before reaching the maximum rental duration. If not, the Member will be charged a late fee in accordance with the amount specified in these terms and conditions.
  • If the vehicle returned in an unsatisfactory condition and requires repair or cleaning work in addition to routine maintenance, Member must responsible for the cost of such repairs.
  • Member are required to ensure that the car door & window are tightly closed and all electronic/engine/electrical functions are turned off when the vehicle is returned. If not, the member will be fine in accordance with the applicable regulation in this agreement.

Payment

  • The applicable vehicle rental rates can be found when the Member booking a vehicle or after using the vehicle. Rental rates are calculated based on the duration of the rental.
  • Member agree to make full payment for the rental vehicle that has been used, including all types of additional cost / fine that may arise as a result of the Member's mistake when using Share Car.
  • Payment can be made via credit card and/or other forms of payment arranged by Share Car.
  • Member's credit card information that has been registered in the application is confidential.
  • The fee for using the vehicle that is charged include tax is in accordance with the applicable laws and regulations.
  • Member must ensure that the credit card registered in application is a valid credit card.
  • If Member cancel an order shortly after the car key is opened, then the 1 hour vehicle rental fee will be charged to Member's credit card.

Refund

  • If something happens that require a refund on the Member's account, Share Car need 7 to 14 working days to process the refund.
  • Refunds can be in the form of Share Car voucher or it can be refund to the balance on the Member's credit card depending on the case.

Fine ans Additional Fees

  • Share Car determine fines and additional fees (not including VAT) for violation committed by Member and Member are required to make full payment with detail and amount as follow :
    1. Member will be fined Rp.100.000 / hour if Member return the vehicle exceed rental maximum duration that has been determined by Share Car
    2. Smoking in the vehicle, a fine of Rp.500.000
    3. Transporting pet in the vehicle, a fine of Rp.100.000
    4. Returning the vehicle at the end of the Member's trip to a location that doesn’t match Share Car location / initial location, a fine of Rp.100.000
    5. Returning the vehicle in a dirty and smelly condition, including leaving trash in the vehicle, a fine of Rp.100.000
    6. Returning the vehicle with the windows open, a fine of Rp.200.000
    7. Using Share Car for criminal acts / crimes that harm Share Car or other parties, a fine of Rp.5.000.000
    8. Using a Share Car for or with carrying liquor, firearms, narcotics and/or other dangerous objects, a fine of Rp.5.000.000
    9. Vehicle registration lost, a fine of Rp.1.500.000
    10. Vehicle is not driven by the Member who made the booking, a fine of Rp.500.000
    11. Using a Share Car for online taxi needs, offline taxis or other similar services, a fine of Rp.500.000
    12. Menggunakan Share Car untuk kebutuhan taxi online, taxi offline atau layanan sejenis lainnya, denda sebesar Rp.500.000
    13. Lost parking card/ticket of Share Car parking location, a fine of Rp.200.000
    14. Returning the vehicle at the end of the trip with a fuel level less than the initial fuel level before the Member start booking, Member will be charged an additional fuel fee of Rp.13.000 / liter
    15. Traffic and parking violation that result in fine and/or Vehicle must be detained/towed, and cannot be used by other Member, the amount of the fine will be based on the amount of the ticket/violation fee plus administrative fee
    16. Members involved in an accident while using Share Car vehicle, be it intentional or unintentionally (including collision or misuse of our vehicle), will immediately incur Administrative and Repair Fees, based on the severity of the damage subjected to our vehicle:
      1. Minor Damage: includes but not limited to damages on the very top layer of vehicle coating with depth of max. 0,5 cm or not exposing the plastic or metal layers underneath the paint. Length of damage a maximum of 5 cm or damage only subjected to 1 vehicle panel which can be a form of hairline scratches or light scuffs and not resulting the vehicle to be inoperable, and the repair duration is estimated between 1 - 3 working days. Members immediately charged Rp. 1.000.000, on Credit Card or Other Payment Methods.
      2. Moderate Damage: includes but not limited to damages on the top layer of vehicle coating with depth more than 0,5 cm or exposing the plastic or metal layers underneath the paint. Length of damage between 5 - 10 cm or damage subjected to 2-3 vehicle panels which can be a form of deep scratches, small dents and not resulting the vehicle to be inoperable, and the repair duration is estimated between 4 - 7 working days. Members immediately charged Rp. 3.000.000, on Credit Card or Other Payment Methods.
      3. Heavy Damage and/or TLA (Total Lost Accident): includes but not limited to damages exposing the plastic or metal layers underneath the paint and length of damage more than 10 cm or damage subjected to more than 3 vehicle panels and also includes exposed airbags, causing the vehicle to be unroadworthy and inoperable or wrecked up to 20% of body and the repair duration is estimated more than 7 working days. Members immediately charged Rp. 5.000.000, on Credit Card or Other Payment Methods.
      4. Very serious damage and/or TLA (Total Lost Accident) : include but not limited to open airbags, bent chassis, unfit for driving, vehicle body damage up to 20% and the vehicle must stop operating with a repair time more than 12 days, a fine of Rp.5.000.000
    17. Share Car vehicles must only be driven and operated by registered Member who has successfully made the booking. Violation of this rule that results in a car accident will immediately incur an additional charge of Rp. 1.000.000 on top of repair fees (excluding Damage and Repair Fees) on Credit Card or Other Payment Methods
    18. Returning the vehicle with electronic/engine/electrical on, a fine of Rp.100.000.
  • Payment of fine and additional cost is automatically debited from the Member's credit card. Until all fines are paid, Member can’t use Share Car.
  • Share Car has the right to collect additional cost if in the future it is found that the damage to the vehicle that has occurred is stated to be more severe than the initial estimate damage that has been notified to Member.
  • Member hereby also release Share Car from all accusations that occur as a result of the Member's mistake, whether intentional or unintentional when using Share Car which violate the applicable laws in Indonesia.

Payment of fines & additional fees

  • Payment by Member is carried out by using a credit card or debit card or other forms of payment determined by Share Car. Member have to ensure credit card and/or debit card have sufficient fund or credit to pay bills arising from the use of Share Car. Member is fully responsible for any associated bank or credit card fee or charge. Member may be charged a processing fee for declined credit card or debit card payment.
  • The circumstance referred to previous article where Share Car may apply for fines against Member for losses that arising during Member's rental period are damages as a result of or in connection with: (a) Member's breach the applicable contract; (b) Member's unlawful activity; (c) Accident ; (d) False report submitted by Member regarding accident report, insurance claim or police report; (e) Intentional damage; (f) Using the Share Car for inappropriate activities (e.g : transporting food, flammable materials, illegal drugs, firearms / sharp tools, using vehicle for commercial purpose); (g) Book Share Car for other people.
  • If there is a payment that still outstanding, Share Car has the right to prohibit Member from making further booking until all outstanding fees in the Member's account have been fully paid.
  • Member agree to pay the fee specified in the agreement, including specifically and without the limitations stated in these terms. Other cost that have not been listed in this agreement and will be applied on Share Car will be communicated to Member.

Left / Lost Items

  • Reporting left / lost item via Call Center 1500-369, Whatsapp +62 81295555927 or email info@sharecar.co.id.
  • Share car is not responsible for the item left behind or damaged after the Member's trip is over.
  • Share Car will store leftover item for a maximum of 14 days from the Member's booking date.
  • Perishable goods (such as food/drink) will be discarded after 24 hours.
  • Share Car only provide item pick-up services from Monday - Friday according to operating hours 09:00 - 16:00. Members must show their ID Card, email & phone number registered in Share Car application for the pick-up process.
  • Share Car doesn’t provide goods delivery services to Member location.

Account Deletion

  • Members can delete account through the profile menu in Share Car application.
  • Member can’t delete their account if Member still has unpaid bill in Share Car.
  • Member who delete Share Car account, all personal data and other detailed data will be permanently deleted from Share Car system. Member can no longer access all data, information, features and services of Share Car, including opening, reactivating or restoring Member's Share Car account.

OTHERS

  • Through this agreement, Member agree to release Share Car from all claims or lawsuits that occur as a result of Member mistake, whether intentionally or un-intentionally when using Share Car.

Termination of The Agreement

  • This agreement will terminate if Member is deactivated as a result of breach of any of his obligations under this agreement or if the Member ceases to be a Share Car Member.
  • This Agreement will continue to apply as long as the Member is still registered in Share Car Membership.
  • Termination of this agreement will not harm or in any way affect the rights and authority of Share Car based on the terms herein in connection with violation that have been committed by Member.
