Terms and Conditions

general definition

  1. Member means an applicant who has registered via Share Car application and has been verified by Share Car.
  2. Vehicle means a motorized vehicle or in this case a car rented by Share Car to a Member in accordance with these terms and conditions.
  3. Share Car is a business unit of PT. Adi Sarana Armada, Tbk.
  4. Terms and conditions mean the rental rules that must be understood and agreed by the Member who will use Share Car vehicles.

share car membership

  1. Members are only allowed to have one registered account on Share Car.
  2. Members are required to fill the registration form with the Member's personal data which can be guaranteed and verified by the Member for its correctness and authenticity.
  3. Members are 21 years old, and have an active Indonesia driving license for at least 1 year or an active Indonesia driving license that still valid for at least 1 month before expired.
  4. Members are required to renew the driving license on Share Car application before expired.
  5. By being a Share Car Member, the Member certify that they have mental and physical capacity to drive a motorized vehicle safely and willing to comply with applicable traffic regulations.
  6. Members with an expired, suspended, cancelled, lost or stolen SIM A are not eligible to become Share Car Members, do not meet the requirements for insurance coverage, and are responsible for any penalties that may be imposed by the relevant authorities.
  7. Approval to become a Share Car Member is entirely Share Car's decision. Decisions regarding membership status will be informed by email.
  8. Share Car has the right to refuse membership or terminate Share Car services to Members any time if the Member is deemed to be potentially detrimental to Share Car and Share Car is not obliged to explain the reasons for terminating services and/or revoking membership.

Share Car Usage Rules

  • Members are required to use and drive the vehicle properly and safely, comply with applicable traffic regulations, and not cross geographical boundaries determined by Share Car. Areas where Share Cars are permitted include Jabodetabek to Merak Port [Western Border] and Semarang [Eastern Border].
  • While using Share Car, Members are not permitted to:
    1. Place an order to be used by someone else;
    2. Using Share Car to learn to drive and/or teach others to drive;
    3. Using Share Car to rent out to other people, online taxi, offline taxi, or other transportation rental services;
    4. Using Share Car to carry alcohol, drugs, fire arms, or another dangerous items.
  • If the Member violates one or all of the provisions stated in point 2 above, Share Car has the right to terminate and/or deactivate the Member's Share Car account, and the Member will be subject to a fine in accordance with the applicable Share Car terms and conditions.
  • Members are fully responsible for all costs (including vehicle repair costs or fully vehicle compensation) arising from violations of these terms and conditions.
  • Members are responsible for vehicle registration, car keys (especially for cars that do not use push buttons), and parking cards during the period of vehicle use. If a loss occurs, all costs of the loss incurred are the responsibility of the Member.
  • Share Car has the right to take over or disable a vehicle that will be or being used by a Member if the Member is deemed to have a risk or indication of misuse of the vehicle.
  • Share Car has the right to take pictures or videos of the vehicle via surveillance cameras for the benefit of Member and vehicle security.
  • The maximum usage duration of Share Car is 48 hours for each order. If the Member wants to use Share Car for more than 48 hours, the Member must confirm in advance with Share Car. If the Member found overused, the Member will be subject to a fine in accordance with the applicable Share Car terms and conditions.

Vehicle Inspection

  • Members are required to check the exterior and interior of the vehicle, the fuel level and vehicle kilometers, and take photos of the vehicle dashboard before and after the trip.
  • If during inspection process Member finds damage, defects, or the condition of the vehicle is dirty, the Member is obliged to report this to Share Car via Share Car application before and after the trip.
  • If there is no report from the Member before the trip, the vehicle is assumed in good condition and free from damage, and if the damage or defects are found at a later date, the costs of the damage or defects will be the Member's responsibility.
  • If damage, defects or dirty conditions are found after the trip and the Member can’t provide valid evidence to show that the findings did not occur during the Member's trip, the Member must be responsible for the repair costs and/or insurance costs incurred on the vehicle.

Vehicle Ownership

  • The vehicle and all accessories (equipment, spare tire key) and other supporting documents (vehicle registration, parking card, etc.) are the property of Share Car. Members are not allowed to remove, move, exchange, modify, damage, or take it all.
  • Members are not permitted and have no right to pawn, guarantee or transfer ownership of Share Car vehicles to other people.

VEHICLE RETURN

  • Members are required to return the vehicle to its pickup location.
  • Members are required to return the vehicle before reaching the maximum rental duration. If the return is made after the rental duration limit, the Member is obliged to pay a late fee in accordance with the applicable Share Car terms and conditions.
  • Members are required to ensure that the vehicle doors and windows are tightly closed, and all electronic/engine/electrical functions are turned off when returning the vehicle. If the Member violates these provisions, the Member will be subject to a fine in accordance with the applicable Share Car terms and conditions.
  • If the vehicle is returned in a dirty, defective or damaged condition, and the vehicle requires repair or cleaning work outside of routine maintenance, Member must be responsible for all repair or maintenance costs incurred.
  • If the Member is willing to return the vehicle but the parking lot is being used by another vehicle, the Member required to report it to Share Car via WhatsApp to ensure that the unit is at the location and where the last unit is.

Payment

  • The applicable vehicle rental fees can be seen when the Member makes a booking and/or after the Member has finished the trip. Rental fees are calculated based on the duration of the rental.
  • Members are required to make full payments for the vehicle rental costs that have been used, including all types of additional fees/fines that may arise due to Member errors or negligence when using the Share Car vehicle.
  • Members are required to register a valid credit card in the Share Car application for payment of rental fees and other additional fees (if any).
  • Payment will be paid by credit card that has been registered in the Share Car application. If for one or another reason the payment is not successful, the payment can be made via another payment method arranged by Share Car.
  • Member’s credit card information that has been registered on the Share Car application is confidential and will only be used for the purpose of paying Share Car rental fees as explained in points 2 and 3 above.
  • All costs charged, both rental costs and other additional costs (if any), will take into account taxes, follows the applicable laws and regulations.
  • If a Member cancels a booking shortly after the car key is opened, the trip fee for the first hour will still be charged to the Member's credit card.

Refund

  • If there is one or another reason that requires a refund to the Member, Share Car will make the refund no later than 14 days from the date of the case occured.
  • Refunds can be given by providing a Share Car voucher or returning the balance on the Member's credit card, depending on the type of problem occurred.

Fine ans Additional Fees

  • Details of the fines or additional fees (exclude VAT) for violations committed by Members are determined as follows :
    1. Members return the vehicle after the rental time limit determined by Share Car, subject to a fine of IDR 100,000 per hour.
    2. Smoking in the vehicle, a fine of IDR 500,000.
    3. Carrying pets in the vehicle, a fine of IDR 100,000.
    4. Returning the vehicle not to its pickup location, a fine of IDR 100,000.
    5. Returning a vehicle in a dirty and smelly condition, including leaving rubbish in the vehicle, will result in a fine of IDR 100,000.
    6. Returning a vehicle with the windows and/or doors open or not properly closed, a fine of IDR 200,000.
    7. Using Share Car for criminal acts/crimes that harm Share Car and/or other parties, fine of IDR 5,000,000.
    8. Using Share Car to carry liquor, firearms, narcotics and/or other dangerous objects, a fine of IDR 5,000,000.
    9. Losing vehicle keys (vehicles that do not use push buttons), a fine of IDR 1,000,000.
    10. Losing vehicle registration, a fine of IDR 1,500,000.
    11. The vehicle is driven by someone else (not by the member who owns the account), a fine of IDR 500,000.
    12. Using Share Car for online taxis, offline taxis or other transportation rental services, a fine of IDR 500,000.
    13. Losing Share Car vehicle parking card/ticket, a fine of IDR 200,000.
    14. Returning a vehicle with a fuel level less than the fuel level when the Member started the trip, the Member will be charged an additional fee of IDR 13,000 per liter.
    15. Traffic and parking violations that result in fines and/or the vehicle must be detained/towed so that it cannot be used by other Members. Members will be fined according to the ticket or violation fee determined by the authorities plus the administration fee.
    16. Returning the vehicle with the electronics/engine/electrical still on, a fine of IDR 200,000.
  • Members involved in incidents/accidents, whether intentional or not (including collisions or misuse of vehicles), will immediately be subject to administrative fines and damage repair fines in the following damage categories :
    1. Light damage : includes but is not limited to damage to the vehicle coating layer with a depth of no more than 0.5 cm (does not result in visible plastic or metal material behind the paint). The length of the damage is no more than 5 cm or occurs on only 1 panel of the vehicle, the type of damage can be in the form of fine scratches, but the vehicle can still be operational, with a workshop repair time of 1-3 working days. For minor damage, Members will be subject to a fine with a nominal value of IDR 500,000 - IDR 1,000,000 (according to the results of the analysis from the Share Car Team) and the fine will be billed directly via credit card or other type of payment.
    2. Medium damage : includes but is not limited to damage to the vehicle coating layer with a depth of more than 0.5 cm (resulting in visible plastic and metal material behind the paint). The length of the damage is between 5-10 cm or occurs on 2-3 panels of the vehicle, the type of damage can be in the form of deep scratches, dents/small dents, however the vehicle can still be operational with a workshop repair time of 4-7 working days. For moderate damage, Members will be subject to a fine with a nominal value of IDR 1,000,000 - IDR 3,000,000 (according to the analysis results from the Share Car Team) and the fine will be collected immediately via credit card or other type of payment.
    3. Severe damage and/or TLA (Total Lost Accident) : includes but is not limited to damage that causes the plastic and metal material behind the paint to be visible, the length of the damage is more than 10 cm or occurs on more than 3 vehicle panels, the airbag is opened, the chassis is damaged, the vehicle is unfit to drive, damage to the vehicle body is up to 20%, and the vehicle must stop operating with a workshop repair time of 7-12 days. For serious damage, Members will be subject to a fine with a nominal value of IDR 3,000,000 - IDR 5,000,000 (according to the analysis results from the Share Car Team) and the fine will be collected directly via credit card or other type of payment.
    4. Very serious damage and/or TLA (Total Lost Accident): includes but is not limited to open airbags, bent chassis, vehicle unfit to drive, vehicle body damage of more than 20%, and the vehicle must stop operating with a workshop repair time of more than 12 days. For very serious damage, Members will be subject to a fine with a nominal value of at least IDR 5,000,000 and the fine will be collected immediately via credit card or other type of payment.
  • Share Car can only be driven by registered Member who has successfully made the booking in the Share Car application. Violation of this rule that results in a car accident will immediately incur an additional charge of Rp.1.000.000 (exclude damage and repair fine) that will be charged via credit card or antoher payment method arranged by Share Car.
  • All decisions regarding the results of the analysis of determining sanctions and/or fines from the Share Car Team are final and cannot be contested.
  • Fines and additional fees (if any) payment will be automatically charged to the Member's credit card and Members cannot use the Share Car service until all the outstanding payments have been fully paid.
  • Share Car has the right to collect additional compensation costs if it is later discovered that the damage to the vehicle that has occurred is stated to be more severe than the initial estimate notified to the Member.
  • Members will indemnify Share Car from all legal claims arising as a result of Member errors that violate applicable laws in Indonesia, whether intentional or unintentional, when using Share Car.

Payment of fines & additional fees

  • Fine and additional costs will be paid by a credit card or other form of payment (if there is a problem with the credit card) arranged by Share Car.
  • Members are obliged to ensure that the payment instrument used, such as a credit card or other payment instrument used, has sufficient funds or credit to pay the costs arising from the use of Share Car. Members are fully responsible for all costs, including related bank or credit card fees.
  • The circumstances referred to in the previous article where Share Car can apply for fines against a Member for losses suffered by Share Car that arise during the Member's rental period are damages that arise as a result of or in connection with: (a) Member's breach of the applicable contract; (b) Unlawful activities by Members; (c) Accident incidents; (d) Errors in reports provided by Members regarding accident reports, insurance claims, or police reports; (e) Intentional damage; (f) Use of Share Car for activities that are not permitted (transportation of foodstuffs, flammable materials, illegal drugs, firearms/sharp weapons, use of vehicles for commercial purposes); (g) Using Share Car for someone else, other than the Member.
  • If the Member has not completed the outstanding payments, Share Car has the right to prohibit the Member from using Share Car until all the outstanding payments are fully paid.
  • Members are willing to pay all fees determined in accordance with these terms and conditions, including other fees that have not been stated in these provisions. Other fees that have not been stated in these terms and conditions and will be applied by Share Car will be further communicated to Members.

Left / Lost Items

  • Reporting and/or collecting left/lost items can be submitted via Call Center 1500-369, Whatsapp +62 81295555927, or email info@sharecar.co.id.
  • Share Car is not responsible for maintenance and/or damage arising to the items left behind after the trip is over.
  • Share Car will keep the items left behind for up to 14 days from the Member's order date. If by this time limit the items have not been taken back by the Member, Share Car has the right to dispose the items.
  • Especially perishable items, such as food and/or drinks, if within 24 hours the Member has not taken them back, Share Car has the right to clean and dispose of the items.
  • Members are required to inform Share Car first if they wish to collect the items left behind.
  • Collection of left behind items that have been stored by Share Car is only served Monday to Friday during operational hours, start from 09:00 until 16:00 WIB. Members are required to show their ID Card, email, and phone number registered in the Share Car application when picking up.
  • Share Car does not provide items delivery services to Member locations.

Account Deletion

  • Members can delete their accounts through the profile menu in the Share Car application.
  • Account deletion can only be done if the Member has no outstanding payment on Share Car.
  • If the Member deletes account, all of the Member's personal and others detailed data will be permanently deleted from the Share Car system so that the Member can no longer access all Share Car data, information, features and services, including opening and reactivating a Share Car account.

Termination of The Agreement

  • This agreement (terms and conditions) ends when the Member is deactivated as a result of violating one of Member’s responsibilities stated in these terms and conditions or the Members is no longer a Share Car Member.
  • These terms and conditions apply as long as the Member is still registered as a Share Car membership.
  • Termination of this agreement will not harm or affect Share Car's rights and authority in connection with violations committed by the Member.

OTHERS

  • By reading and understanding these terms and conditions, Member agree to release Share Car from all requisites and/or lawsuits that occur as a result of Member mistakes while using Share Car, whether intentionally or unintentionally.
